General terms and conditions room booking

1. Applicability

These General Terms and Conditions of Room Booking (‘GTC’) apply for all Sorell Hotels in the group of ZFV companies (Genossenschaft ZFV-Unternehmungen) based in Zurich in connection with the provision of hotel rooms to customers as accommodation as well as all other services and deliveries provided by the Hotel in this context.

The general terms and conditions of the customer do not apply.

The terms and conditions are also available in French and German. In the event of deviation, the German version is decisive.

2. Conclusion of contract

An individual reservation is valid until 4:00 pm on the day of arrival if no security deposit is paid. If a security deposit has been paid for a room, your reservation shall remain valid all night even if you arrive after 4:00 pm.

The following count as security deposits for a room reservation:

  • Credit card (Visa, American Express, Diners Card, Mastercard, JCB, CUP)
  • Advance payment for a night, e.g. by bank or postal transfer
  • A written guarantee from a company registered in the commercial register and based in Switzerland

A quotation for group reservations shall be expressly designated as such and must be signed by the customer and returned to the Hotel. A quotation is valid for seven days (acceptance term). In particular, this means that quotations, price lists etc. issued by a Hotel do not yet represent a binding offer.

The Hotel expressly reserves the right to re-sell the rooms during and after the acceptance term for the quotation for group reservations. If a new enquiry is made, the new quotation may differ from the first quotation.

3. Services and prices

The customer has no legal entitlement to be provided with certain rooms, although the Hotel undertakes to keep rooms in the reserved category available. If, due to unforeseeable circumstances, no equivalent room to the reserved one can be found upon arrival, the customer shall be provided with a room in the next category up. If no rooms are available in the hotel, the Hotel shall provide accommodation in at least the same room category in another hotel. Furthermore, the Hotel shall transport the customer and his or her luggage to and from the other hotel and cover the cost of a three-minute international phone call in order that the new address can be communicated.

The customer is obliged to pay the valid and/or agreed prices of the Hotel for use of the room and for the other services he or she uses. This also applies to services and expenses of the Hotel that the customer arranges for third parties.

The prices are in Swiss francs (CHF), per room per night, including free Wi-Fi, service and VAT. The city tax per person per night is not included in the prices.

4. Handover and return of rooms

Reserved rooms are available to the customer from 3:00 pm on the agreed day of arrival. The customer is not entitled to access the room before this time.

On the agreed day of departure, the rooms must be vacated and returned to the Hotel by noon at the latest. After this time, if the customer fails to vacate the room on time, the Hotel can charge 50% of the full list price for the non-contractual use of the room until 6:00 pm and 100% after 6:00 pm.

5. Payment

Invoices of the hotel with no due date are payable in full within 10 days. The hotel is entitled to declare accrued receivables payable at any time and demand their immediate payment.

The Sorell Hotel is entitled to request a reasonable advance payment or security deposit upon the conclusion of the contract or thereafter. The amount of the advance payment and the payment deadlines shall be set out in the quotation.

If the customer is based abroad, the Hotel reserves the right to charge the full invoice amount to the credit card that was used to pay the security deposit. Any exchange rate difference or bank fees must be borne by the customer.

The customer may only offset his or her claims against a claim of the Sorell Hotel if the customer’s claim is not disputed or has been established by final judgement.

6. Conditions of cancellation

6.1 Conditions of cancellation for individual reservations

Individual reservations are normally considered definitive once the price quoted by the Hotel has been accepted. If the customer cancels at short notice after the expiry of the cancellation deadline, the full price of an overnight stay can be invoiced to the customer.

The conditions of cancellation can vary by hotel and available rooms. However, special conditions that preclude cancellation apply at certain rates. Unless indicated otherwise, individual reservations are subject to the following conditions:

- Cancellation by 4:00 pm on the day of arrival: no cost
- Cancellation after 4:00 pm on the day of arrival: cost of one night
- Cancellation during the stay (multiple nights): cost of one further night

6.2 Conditions of cancellation for groups

The conditions of cancellation for group reservations are dependent on the size of the group and are governed separately.

If no separate conditions of cancellation exist, the following rules apply:

- Cancellation up to 60 days prior to arrival: free
- Cancellation up to 59-30 days prior to arrival: 50% of the expected total revenue
- Cancellation up to 29-15 days prior to arrival: 75% of the expected total revenue
- Cancellation up to 14-0 days prior to arrival: 100% of the expected total revenue

7. Withdrawal by the Sorell Hotel

Where the customer has cancelled free of charge in accordance with section 6 or under a separate agreement, the Hotel is entitled to withdraw from the contract during this period if other customers have made enquiries concerning the contractually booked rooms and the customer does not waive his or her right to cancel free of charge upon being asked by the Sorell Hotel.

Likewise, if an agreed advance payment is not made even after the expiry of a reasonable subsequent deadline set by the Hotel, the Hotel shall be entitled to withdraw from the contract.

Furthermore, the Hotel is entitled to withdraw from the contract with immediate effect if it has objectively justifiable grounds to do so, such as if:

  • Force majeure or other circumstances for which the hotel is not responsible make it impossible to execute the contract
  • Rooms have been booked on the basis of misleading or inaccurate information, e.g. relating to the identity of the customer or the purpose of the booking
  • The hotel has a legitimate reason to assume that the use of the hotel service might jeopardise the smooth running of business, the security of the hotel or its public image, without this being attributable to the management or organisation of the hotel
  • Section 5 is breached

If the hotel withdraws from the contract for a legitimate reason, the customer shall not be entitled to compensation.

8. Reservations via travel businesses

If a reservation is made through a travel business, its general terms and conditions apply.

9. Prices for children

Free cribs are available on request for children under the age of two. Children up to their 6th birthday can sleep in their parents’ bed free of charge. Children from 6 years up to their 12th birthday stay in an extra bed for an additional charge of CHF 50.- night.  From 12 years the extra charge for an additional bed is CHF 70.- per night.

10. Liability/duty of care

The customer must treat the hotel room with the greatest of care. The customer or company must pay compensation for any damage caused.

The hotel cannot be held liable for theft etc. or in connection with third-party services. Furthermore, the hotel can only be held liable for direct contractual or non-contractual damage in cases of intent or gross negligence. All further liability is excluded.

12. Final provisions

In addition to the GTC, other provisions and reservation conditions that take precedence over the GTC can apply. Amendments or additions to the accepted offer or these GTC must be made in writing. Unilateral amendments or additions by the customer shall not be effective.

The place of fulfilment and payment is the registered office of the Sorell Hotel.

Swiss law applies; the place of exclusive jurisdiction is Zurich.

If any provision of these GTC should be or become ineffective or void, this shall not affect the effectiveness of the remaining provisions. Otherwise, the statutory regulations apply.

These General Terms and Conditions of Events (‘Events GTC’) apply to all hotels in the group of ZFV companies (Genossenschaft ZFV-Unternehmungen) based in Zurich in connection with the rental of seminar rooms, banquet halls and event rooms (‘rooms’) as well as all other related services or deliveries to and for the customer or organiser.

The rented rooms or areas may not be sublet, and no invitations may be issued to interviews, marketing or similar events without the prior written consent of the Sorell Hotel.

The general terms and conditions of the organiser do not apply.

The terms and conditions are also available in French and English. In the event of deviation, the German version is decisive.

2.  Reservations

A quotation for renting rooms shall be expressly designated as such and must be signed by the customer and returned to the hotel. A quotation is valid for seven days (acceptance term). In particular, this means that quotations, price lists etc. issued by a hotel do not yet represent a binding offer.

The Sorell Hotel expressly reserves the right to re-sell the rooms during and after the acceptance term for the quotation. If a new enquiry is made, the new quotation may differ from the first quotation.

The price lists are specific to each hotel; prices are subject to change. All prices are net and in Swiss francs (CHF), including service and VAT. The prices apply as confirmed by the hotel in writing.

4. Payment

Invoices of the hotel with no due date are payable in full within ten days. The hotel is entitled to declare accrued receivables payable at any time and demand their immediate payment.

The hotel is entitled to request a reasonable advance payment or security deposit upon the conclusion of the contract or thereafter. The amount of the advance payment and the payment deadlines shall be set out in the quotation.

If no separate advance payment conditions exist, the following rules apply:

  • Advance payment up to 30 days prior to arrival: 50% of the expected total revenue
  • Advance payment up to 14 days prior to arrival: 100% of the expected total revenue

If the organiser is based abroad, the hotel reserves the right to charge the full invoice amount to the credit card that is being used for the security deposit or full payment must be transmitted prior to the event. Any exchange rate difference or bank fees must be borne by the organiser.

The customer may only offset his or her claims against a claim of the hotel if the customer’s claim is not disputed or has been established by final judgement.

5. Joint and several liability for payment

If the customer is not also the organiser, the customer and the organiser shall be jointly and severally liable for payment of the full invoice amount. This liability applies even if direct payment has been expressly agreed.

6. Conditions of cancellation

Notices of cancellation shall only be accepted in writing. The hotel reserves the right to adjust the conditions of cancellation on the basis of the nature and scale of the event and to incorporate them into the quotations/confirmation of reservation.

If no separate conditions of cancellation exist, the following rules apply:

  • Cancellation up to 60 days prior to arrival: free
  • Cancellation up to 30 days prior to arrival: 50% of the expected total revenue
  • Cancellation up to 14 days prior to arrival: 100% of the expected total revenue

14 days to 48 hours before the event, deviations up to a maximum of 10% of the number of participants can be reported and are binding. If the actual number of people is smaller on the day of the event, the bill shall be based on the definitively confirmed number. The additional costs resulting from additional participants shall be invoiced. The maximum safe occupancy levels set by the fire brigade for each room may not be exceeded.

7. Withdrawal by the Sorell Hotel

Where the customer has cancelled free of charge in accordance with section 6 or under a separate agreement, the hotel is entitled to withdraw from the contract during this period if other customers have made enquiries concerning the contractually booked rooms and the customer does not waive his or her right to cancel free of charge upon being asked by the hotel.

Likewise, if an agreed advance payment is not made even after the expiry of a reasonable subsequent deadline set by the hotel, the hotel shall be entitled to withdraw from the contract.

Furthermore, the Sorell Hotel is entitled to withdraw from the contract with immediate effect if it has objectively justifiable grounds to do so, such as if:

  • Force majeure or other circumstances for which the hotel is not responsible make it impos-sible to execute the contract
  • Rooms have been booked on the basis of misleading or inaccurate information, e.g. relating to the identity of the customer or the purpose of the booking
  • The hotel has a legitimate reason to assume that the use of the hotel service might jeop-ardise the smooth running of business, the security of the Sorell Hotel or its public image, without this being attributable to the management or organisation of the hotel
  • Section 4 is breached
  • A breach of section 8 below

If the Sorell Hotel withdraws from the contract for a legitimate reason, the customer shall not be entitled to compensation.

8. Detailed information/course of events

n appointment must be booked in advance for details to be discussed. In order to ensure that the event runs smoothly, all important information (e.g. furnishings, menu selection, schedule, interludes for shows etc.) must be communicated to the hotel no later than 10 days prior to the event. Both parties must adhere to the agreed programme times without exception.

9. Room use

In exceptional cases, the hotel is entitled to make room changes at short notice for events. In any case, if there are fewer people than expected, the hotel reserves the right to provide a room befitting the number of participants and the occasion. Reception desks, promotional material, banners etc. may only be set up outside of the rented rooms in coordination with the hotel. Public areas of the hotel may not be used for group work. Group work must take place in the agreed group rooms. Smoking is not permitted anywhere in the hotel.

10. Menu changes

The Sorell Hotel reserves the right to make changes to menus and wine vintages.

11. Corkage

The organiser and guests may not bring their own food or drink to events. Exceptions are subject to a written agreement with the hotel. If guests bring their own wines, spirits, cakes etc., corkage shall be charged on top of the total sum in order to cover overheads.

12. Flowers and decorations

Decorations and other items are subject to consent for reasons including fire safety. Any damage caused by putting up decorations etc. shall be billed to the organiser.

13. Parking

Parking is normally available at or in the vicinity of the hotel. Unless agreed otherwise, the organiser or the individual participants shall pay any parking charges.

14. Technical equipment and connections

If the hotel procures technical or other equipment from third parties on the request of the organiser, it shall act in the name, on behalf and on the account of the organiser. The organiser is responsible for handling such equipment with care and returning it on time. The organiser shall indemnify the Sorell Hotel against all third-party claims resulting from the use of such equipment.

The organiser may not use his or her own electrical equipment on the main grid of the Sorell Hotel without the written consent of the hotel. Any disruptions or damage to the technical systems of the hotel resulting from the use of these devices must be paid for by the organiser unless the Sorell Hotel was responsible for it. The hotel may assess and charge a lump sum to cover the cost of electricity resulting from the use of the devices.

With the consent of the hotel, the organiser is entitled to use his or her own phone, fax and data transfer equipment. Thehotel may charge a connection fee for this.

If suitable equipment belonging to the hotel is left unused because the organiser connected his or her own devices, the hotel can charge compensation for the loss of use.

Where possible, problems with the technical or other equipment provided by the hotel shall be fixed immediately. Payments cannot be withheld or reduced unless the hotel was responsible for the problems.

Subject to an arrangement with the hotel, a technician can be made available to provide technical support during an event. Minor measures can be handled by the hotel at any time on request. For larger-scale meetings with video, audio or microphone support, the organiser is advised to hire an external technician to provide support. No price reduction can be claimed on the basis of technical disrup-tions or defects.

15. Fire safety regulations

The organiser undertakes to adhere to the fire safety regulations of the hotel, in particular by not obstructing emergency exits, and guaranteeing that all materials brought by the organiser are compliant with the fire safety regulations. The use of flammable materials is strictly prohibited.

16. Delivery and collection of materials

Deliveries and collections for events must be coordinated with the hotel and reported to the hotel in writing in good time, at least before they arrive. The hotel reserves the right to refuse to accept deliveries with no sender or valid addressee including details of the event. The hotel rejects any and all resulting obligations or liability. As storage space in the hotel is limited, the hotel can refuse to accept materials before the day of the event.

In the case of a delivery to Switzerland from abroad, customs duties and VAT are payable on top of the delivery costs. Should the carrier be unable to specify the exact costs upon dispatch, we reserve the right to add a fixed amount of CHF 100 to the invoice of the organiser.

17. Musical entertainment, closing time and night shift premium

If an event involves music, please note that music is only permitted at a low volume after 11:00 pm. DJs and bands are obliged to keep the bass low and cover the floor underneath the instruments with a carpet or rug in order to suppress the sound. Music may not be played at all after 2:00 am. Outdoor musical performances with speaker systems require the permission of the police at least four months prior to the event. If the instructions are not adhered to, any additional expenses must be covered by the organiser. The organiser is responsible for clarifying any and all royalties in connection with musical performances and must pay them at his or her own expense.

If a performance goes beyond the legally admissible closing time, a night shift premium must be charged.

The hotel must be notified of the extension of the closing time at least one month prior to the event.
The hotel shall obtain the necessary police permission and pass on the costs to the organiser.

After 11:00 pm, windows and doors must be kept closed and the volume of the music must be lowered. Guests who are outdoors are asked to conduct themselves quietly. The instructions of the hotel staff must be followed. The organiser shall be held responsible for any complaints or fines.

After 11:00 pm, a surcharge per hour can be charged for the employees who are working as part of the event.

18. Guest rooms
The General Terms and Conditions of Room Bookings apply to the reservation of guest rooms. The following supplemental or deviating provisions also apply.

Breakfast is usually included in the price of each room. If other conditions apply it will be with a written notice.

For events involving overnight accommodation, the organiser must provide the hotel with a list of rooms containing the following details of the individual guests at least 14 days prior to the arrival of the hotel guests: First names and surnames/arrival and departure details/payment conditions.

If the organiser reserves a block of rooms without a list, the hotel rooms must be booked by the guests directly and a valid credit card must be used to pay a security deposit for each one. Upon the expiry of the deadline set by the Sorell Hotel, the rooms in the block that have not been booked shall be made available to the public again. In any case, the organiser is responsible for unpaid costs for the rooms booked by his or her guests and their consumption (no-shows, mini bar etc.).

19. Liability/duty of care

The guest must treat the rooms and materials with the greatest of care. The organiser must pay compensation for any property damage or losses that occur. The hotel cannot be held liable for theft or damage or in connection with third-party services. This also applies to personal injuries unless they were caused by employees of the hotel. The hotel can be held liable within the bounds of the statutory provisions.
